Chapter 13  Bankruptcy Attorney | Chapter 13 Debt Relief Information

David A. Casey - Chapter 13 Attorney

Bankruptcy in La Mesa, El Cajon, and East County of San Diego

365 Broadway, Suite 203

             El Cajon, California

                   (619) 447-6780

We are a debt relief agency. We help people file for relief under the Bankruptcy Code.

The Law Office provides personal service to clients who need debt relief using Chapter 13 and with professional legal representation for Chapter 13 bankruptcy at reasonable rates.  Filing for Bankruptcy is a major and important decision that will affect you financially.  Attorney Casey provides you with the time necessary to ensure that the bankruptcy process is done properly.  Attorney Casey's philosophy is to treat every client with respect as we would expect to be treated if there was a change of events that affected our lives.  The purpose of bankruptcy is to seek relief from your financial hardship, stop foreclosures,  and put a stop to unreasonable harassing creditors pursuant to the bankruptcy laws. For many, Chapter 13 Bankruptcy is a legal procedure to get you back on track.  Many times on unsecured debt you may only have to pay a small amount instead of the entire debt.

For Chapter 7 Bankruptcy fees please call my office.  All attorney fees have to be approved by the bankruptcy court as reasonable.

In most Chapter 13 Bankruptcies you only have to pay the filing fees upfront and a small pre-bankruptcy fee.  Attorney fees are set at the court presumed rate unless otherwise indicated.  This is the amount the court has determined as reasonable. The attorney fees are paid out of the Chapter 13 plan.  We are here to make this as easy as possible.

In the last year, bankruptcy filings have increased 30%. The primary reason for filing personal bankruptcy is an unforeseen financial down turn, loss of savings and unable to borrow funds at a reasonable rate. Many have over time had medical expenses, excessive credit card debt, loss of employment, death of a family member and divorce.  La Mesa 91941, La Mesa 91942, La Mesa 91943, La Mesa 91944,

California - Chapter 13 Bankruptcy Information

La Mesa Chapter 13 | Bankruptcy Attorney | Chapter 13 Relief

Many times you will hear Chapter 13 as a repayment  plan or a wage earner plan.  Under a Chapter 13 bankruptcy, the debtor  proposes a 3-5 year repayment plan to the creditors offering to pay off all or part of the debts from the debtor's future income. After reviewing all the facts, I can direct you what is right for you.

Debtor Relief, Chapter 13 Bankruptcy. La Mesa, CA 13 Debt Relief

Chapter 13 can be used to  prevent a house foreclosure, make up missed  or late trust or  mortgage payments,  stop or lower interest from accruing on your tax debt, and pay back taxes, (local, California state taxes, or the IRS federal).  You can also keep non-exempt property which you would have been required to liquidate under a Chapter 7 but don't have to under Chapter 13.  If you finish the plan and make the payments under the terms of your repayment agreement, all your remaining dischargeable debt will be released at the end of the plan (typically three to five years). How much will you have to pay under  Chapter 13?  The amount to be repaid is determined by different legal  factors including the debtor's disposable income. Also, the minimum total amount paid to creditors under the Chapter 13 plan must be at least the amount that the debtor would have paid the creditors.  Under a Chapter 13 bankruptcy protection you must have a "regular source of income" and this regular source of income must include some disposable income to make payments under the Chapter 13 payment plan.

Chapter 13 bankruptcy is generally used mainly by debtors who have delinquent debts and  have secured assets and want to keep them. This can be a home, car, equipment where the debtor has  more equity in the secured assets than is allowed under bankruptcy exemptions.  Chapter 13 bankruptcy is a chance to reorganization your debt whereas a Chapter 7 bankruptcy is a liquidation of all but exempt assets.

Under a Chapter 13 bankruptcy you are allowed to make up overdue payments over time and to reinstate the original agreement. You can keep valuable nonexempt property under a Chapter 13 plan.  In many cases, Chapter 13 can be a better option than a seven.

However, if you want to eliminate your heavy debt burden and don't want to make payments for 3-5 years, then Chapter 7 is the way to go if you meet the means test.

Buying a home or getting a new credit card after bankruptcy?

YOU  MAY HAVE HEARD HORROR STORIES FROM CREDITORS  that if you file bankruptcy you will not be able to get credit or you will not be able to buy a home.

The credit card company or home lender must determine whether or not to lend to a person after filing bankruptcy.  What the banks consider when determining your risk status is your current status. As for a home, the most important factor that they will consider is your current debt to income ratio, in other words, how much outstanding debt you have relative to your income coming in.  If you are thinking about bankruptcy most likely you have a very high outstanding loan or high consumer accounts and probably would not qualify for a refinance or new loan. They want to make sure your mortgage payment is no greater than 30% of your gross monthly income. So let’s put this in perspective, right now, calculate how much income compared to your monthly debt payments.

After filing bankruptcy you have no outstanding debt and cannot file for another eight years. In fact, you look like a much better candidate for credit card companies after filing bankruptcy. You even have the money to pay the credit card amount each month without any interest charges.

Thinking about buying a home after chapter 7 bankruptcy? Studies indicate that around 90% of individuals after filing bankruptcy receive solicitation from a lender actually indicating that they knew they had filed bankruptcy. So remember, credit is your ability to borrow money, and that may actually improve after filing bankruptcy. Certainly it will improve if you can put money aside to pay your bills, on time, after the bankruptcy and probably to put some money into a savings account.  Bankruptcy is a right granted under the federal law to protect and to help people like you.
